The rules, in plain English. It's short on purpose.

These terms are subject to change at any time. Continued use of our product means consent to the updated terms. We don’t want to change them, but some people push boundaries and break the bonds of common decency, so we will likely have to update these periodically. Check the “Last updated” date at the top of this page if you want to know when that last happened.

  • If you want bigger groups or more data, you pay for them. We’re happy to provide
  • DON’T POST ILLEGAL STUFF. We don’t use AI scans and we don’t personally look at your photos — which also means nothing is automatically checking what you upload. But if we become aware of child sexual abuse material, we are required by U.S. law to report it to the National Center for Missing and Exploited Children, and we will happily turn you over to the FBI or whatever law enforcement agency will help turn you into a former customer. We don’t want that business.

Having said that…

Welcome to Photo Fort! Please read on to learn the rules and restrictions that govern your use of our website, products, services, and hopefully soon mobile-apps (the “Services”). These Terms of Use (the “Terms”) are a binding contract between you and Photo Fort, LLC (“Photo Fort,” “we” and “us”). You must agree to and accept all of the Terms, or you don’t have the right to use the Services. Simple enough? Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services.

You must be at least 13 to use the Services. If you are in the European Economic Area, you must be at least 16.

Privacy

What we collect, who can see it, how long we keep it, and how to get it back or get rid of it now live in their own document: our Privacy Policy. It forms part of these Terms — using the Services means you accept both.

The one thing worth repeating here, because it is a term of this contract rather than a disclosure: if you upload photos or write messages, you are giving us permission to store, host, and display them to run the service. There wouldn’t be much point in uploading them otherwise. You grant us a limited license to host and display your content solely to operate the Service for you and your groups. Your content stays yours, and the license ends when you delete it.

Standard liability disclaimers

No guarantees. Our services are provided “as is” and “as available.” We do not promise that they will function 100% of the time. We make no promise that our software will be compatible with your system. Obviously we want it to work well and be awesome because we use it too, but we can’t guarantee a perfect system.

Limitation of liability. Our total liability to you for any claim shall not exceed the amount you paid us in the last 12 months, or $100, whichever is greater.

Choice of Law & Venue. This agreement shall be governed by the laws of the State of Florida, USA. Any suits must be brought in the state of Florida in either the County Court or the Circuit Court for Walton County. Don’t worry, if we go to trial, Walton County has beaches you can visit. Each party shall pay for their own legal expenses, regardless of who wins.

Termination. If you are suspected of violating any of these terms, we reserve the right to freeze your account until the situation is resolved with no liability or damages. If you are determined to have violated the terms, your account may be terminated with no refund or proration. We may also remove specific content without removing your account. Our terms are simple, just behave yourself.

Reporting something. Any member can report a photo or a message from inside the app, and we’ll look at it. You can also email us at photofort@myphotofort.com. We aim to deal with reports within a day.

Leaving or being removed from a group. You can leave a group whenever you want, and a group leader can remove anyone from theirs. Either way, the photos and messages you shared into that group are permanently deleted along with your access to it — when you go, your things go with you. This only affects that one group: anything you shared into your other groups stays exactly where it is, and the group’s calendar is left alone. Download the album first if you want to keep a copy.

Group leaders

If you start a group, you pick who joins your group. You can pick your fellow leaders. You agree to indemnify us if someone doesn’t like your leadership and decides to sue because you allowed bullying, spam, or illegal activity. Since random strangers can’t ask to join your group, everyone is there by invitation. Use your power wisely.

When you upgrade and pay with a credit card, payments are handled by Stripe. Review Stripe’s terms and conditions. We don’t store your credit card info. We don’t want your credit card info.
